(Effective 6 August 2025 – replaces all previous versions)
1.1 These Booking Terms and Conditions ("Conditions") form the contract between Fiji Rugby Experience Pty Ltd ("we", "our" or "us") and each person who books or purchases any travel product,rugby tour, accommodation, activity, service or related arrangement that we organise, sell or facilitate (collectively, the "Services"). By paying a deposit or otherwise confirming a booking you ("you", "your", "Client") agree to be bound by these Conditions. The person making the booking warrants that they have authority to bind all travellers listed on the booking.
2.1 Departure Date – the date the Client is scheduled to leave Australia for the tour.
3.1 A booking is confirmed only when we issue written confirmation and receive the Deposit (see cl 4.1).
3.2 If you book on behalf of a group you must ensure every participant has read and accepted these Conditions and any itinerary‑specific rules.
3.3 Where a Minor travels without their parent or legal guardian, the booking adult accepts full responsibility for the Minor and must provide all required consent forms.
4.1 Deposit – A non‑refundable deposit of AUD $300 - $1000 per traveller (or such other amount advised in the proposal) is payable within 7 days to confirm your booking.
4.2 The deposit amount depends on tour length, group size, and supplier requirements, and is used to secure accommodation, transport, and rugby match logistics which are non‑refundable to us.
4.3 Progress Payment – 25 % of the Package Price is due 60 days prior to the Departure Date.
4.4 Balance – The remaining balance is due 56 days prior to the Departure date
to ensure all supplier services are secured.
4.5 Bookings made within 45 days of departure require full payment at the time of booking.
4.6 All prices are in Australian dollars and include GST (where applicable).
4.7 Currency movements – Land‑based costs are quoted in AUD. Where airfares or third‑party costs are denominated in foreign currency, Fiji Rugby Experience reserves the right to adjust the Package Price if the relevant exchange rate moves by more than 3 % between the quote date and the date the balance is due.
4.8 Payments may be made by bank transfer, credit card or other methods approved by us. Credit‑card payments attract a surcharge disclosed at the time of payment.
5.1 We will use reasonable efforts to accommodate change requests. An amendment fee of AUD 150 per booking applies once confirmation has been issued, in addition to any supplier charges.
5.2 A change in traveller name, tour date or accommodation type may be deemed a cancellation (see cl 6) where suppliers treat it as such.
6.1 Under 13 weeks from departure (91 days): 25% of the total tour cost.
6.2•Under 9 weeks from departure (63 days): 50% of the total tour cost.
6.3 Under 5 weeks from departure (35 days): up to 100% of the total tour cost may be forfeited.
7.1 Fiji Rugby Experience may cancel or materially amend a tour where it is commercially unviable (minimum numbers not met) or a Force Majeure Event makes delivery impossible or unsafe.
7.2 Where we cancel for reasons other than a Force Majeure Event, you may choose to:
(a) receive a full refund of monies paid; or
(b) transfer to an alternative tour of equal or greater value at no additional cost (subject to availability).
7.3 Where cancellation is due to a Force Majeure Event, our obligations are limited to providing a travel credit equal to monies we are able to recover from suppliers, less reasonable administrative costs.
8.1 Comprehensive travel insurance – including cover for rugby participation, medical expenses, evacuation and trip cancellation – must be purchased before final payment. Proof of insurance may be required. We are not liable for loss where you fail to obtain suitable cover.
9.1 Rugby tours are physically demanding. You warrant that you and all participants are medically and physically fit to participate in scheduled rugby matches, training sessions and related activities.
9.2 You must disclose any pre‑existing medical condition or disability that may affect participation at the time of booking. We may refuse a booking if a condition poses material risk to the traveller or the group.
9.3 Dietary, mobility or other special requests are not guaranteed but will be passed to suppliers.
10.1 Rugby is a contact sport that carries an inherent risk of serious injury. By booking you (and each participant) acknowledge and accept those risks and agree to participate in accordance with the laws of the game and directions of accredited coaches and officials. We are not responsible for injuries arising from reckless or negligent play or failure to follow safety instructions.
11.1 Australian passports must have at least 6 months validity beyond your return date. Non‑Australian passport holders must check their own entry requirements.
11.2 You are responsible for obtaining any visas, travel authorisations and recommended vaccinations.
11.3 Fiji Rugby Experience provides general information only and accepts no liability for refusal of entry, quarantine or other travel disruption caused by incomplete documentation.
12.1 Fiji Rugby Experience acts as an agent for hotels, airlines, transport companies and activity providers ("Suppliers"). Your rights against Suppliers are governed by their own terms, conditions and liability limitations.
12.2 To the maximum extent permitted by law, we exclude all implied warranties and are not liable for any loss, damage, delay or expense caused by (a) an act or omission of a Supplier, or (b) an event beyond our control.
12.3 Nothing in these Conditions limits any consumer guarantees or remedies available under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Where our liability cannot be excluded, it is limited (at our option) to supplying the Services again or paying the cost of having the Services supplied again.
13.1 Where a Force Majeure Event occurs, we will: (a) promptly notify you; and (b) use reasonable efforts to provide an alternative itinerary or credit.
13.2 We are not liable for any additional costs incurred as a result of a Force Majeure Event (including, without limitation, airfares, accommodation, testing or quarantine expenses).
14.1 No compensation or refund is payable for Services not utilised, whether by choice, illness, late arrival or other cause.
15.1 If a problem arises during the tour you must inform our local representative or tour leader immediately so that we have an opportunity to resolve it.
15.2 If the matter is not resolved, you must submit a written complaint to us within 30 days of the tour’s end.
15.3 The parties agree to attempt in good faith to resolve any dispute by negotiation before commencing legal proceedings.
16.1 We collect personal information to process bookings and provide travel services. We handle personal data in accordance with our Privacy Policy (available at fijirugbyexperience.com.au/privacy). By booking you consent to the collection, use and disclosure of your information as described in that policy, including disclosure to overseas Suppliers who may not be subject to Australian privacy laws.
17.1 Unless you advise us otherwise in writing, you grant us a perpetual, royalty‑free licence to use images or video taken of you on tour for promotional purposes. All branding, itineraries and materials that we provide are our intellectual property and may not be reproduced without permission.
18.1 The tour leader or nominated representative has full authority to make decisions for the safety and well‑being of the group. 18.2 We may remove any traveller who commits an illegal act, behaves disruptively, endangers others or fails to comply with reasonable instructions. No refund will be given for unused arrangements in such circumstances.
19.1 These Conditions are governed by the laws of New South Wales, Australia. The parties submit to the non‑exclusive jurisdiction of the courts of that state.
20.1 Severability – If any provision of these Conditions is held to be invalid or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.
20.2 Assignment – You may not assign or transfer any rights or obligations under these Conditions without our prior written consent.
20.3 Waiver – Our failure or delay to exercise any right or remedy under these Conditions does not constitute a waiver of that right or remedy.
20.4 Updates – We may amend these Conditions at any time by publishing an updated version on our website. The version in force at the time of booking applies to that booking unless otherwise agreed in writing.
